These Terms of Service (“Terms”) govern your access to and use of the Casa Vietri website and online store (the “Site”) and the purchase of any products from Casa Vietri.

By accessing, browsing or purchasing from the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Site.

We make every effort to accurately display and describe our products.

However:

  • Colours may vary depending on screen settings and devices.

  • Natural materials such as volcanic lava stone may contain variations in tone, texture and surface characteristics.

  • Minor variations are not defects.

All product descriptions and availability are subject to change without notice.

We reserve the right to limit quantities or discontinue products at any time.

4. Orders and Acceptance

When you place an order, you are making an offer to purchase.

A binding contract is formed only when we confirm acceptance of your order and process payment.

We reserve the right to decline or cancel an order for any reason, including pricing errors, stock unavailability or suspected fraud.

Orders cannot be cancelled once accepted and processing has commenced, subject to your rights under Australian Consumer Law.

5. Pricing and Payment

All prices:

  • Are in Australian Dollars (AUD)

  • Include GST where applicable

Shipping costs are displayed at checkout or provided separately where required.

Full payment is required at the time of purchase.

You warrant that you are authorised to use the payment method provided.

We reserve the right to correct pricing errors and cancel orders where necessary.

6. Shipping and Risk

Delivery timeframes are estimates only and are not guaranteed.

We are not liable for delays caused by carriers, customs processing or events outside our reasonable control.

Risk in the goods passes to you upon delivery to the nominated delivery address.

Title (ownership) passes to you once full payment has been received.

7. Returns and Refunds

Returns, exchanges and refunds are governed by our Returns Policy.

Nothing in these Terms limits your rights under the Australian Consumer Law.

8. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

To the extent permitted by law, where goods are not acquired for personal, domestic or household use, our liability is limited to:

  • Replacement of the goods;

  • Repair of the goods; or

  • Payment of the cost of replacing or repairing the goods.

9. Intellectual Property

All content on the Site, including text, images, logos, designs and graphics, is owned by or licensed to Casa Vietri and is protected by Australian and international intellectual property laws.

You may use the Site for personal, non-commercial purposes only.

You must not reproduce, distribute, modify or exploit any content without prior written consent.

We are not responsible for the content, policies or practices of third-party sites.

You warrant that your feedback:

Our total liability for any claim relating to goods purchased through the Site is limited to the amount paid for those goods.

This limitation does not apply to rights you have under the Australian Consumer Law.

We may suspend or terminate access to the Site at our discretion if you breach these Terms.

Provisions relating to intellectual property, liability, indemnity and governing law survive termination.

17. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

You submit to the exclusive jurisdiction of the courts of New South Wales.

The current version will always be available on this page. Continued use of the Site constitutes acceptance of any updated Terms.
