These Terms of Service (“Terms”) govern your access to and use of the Casa Vietri website and online store (the “Site”) and the purchase of any products from Casa Vietri.

By accessing, browsing or purchasing from the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Site.

1. Who We Are

References to “we”, “us” and “our” mean Casa Vietri. References to “you” mean the user or customer.

2. Access and Use

By using the Site, you confirm that you are at least 18 years of age or the age of majority in your state or territory of residence.

You agree to provide accurate, current and complete information when placing an order or creating an account.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

3. Products and Product Information

We make every effort to accurately display and describe our products.

However:

  • Colours may vary depending on screen settings and devices.

  • Natural materials such as volcanic lava stone may contain variations in tone, texture and surface characteristics.

  • Minor variations are not defects.

All product descriptions and availability are subject to change without notice.

We reserve the right to limit quantities or discontinue products at any time.

4. Orders and Acceptance

When you place an order, you are making an offer to purchase.

A binding contract is formed only when we confirm acceptance of your order and process payment.

We reserve the right to decline or cancel an order for any reason, including pricing errors, stock unavailability or suspected fraud.

Orders cannot be cancelled once accepted and processing has commenced, subject to your rights under Australian Consumer Law.

5. Pricing and Payment

All prices:

  • Are in Australian Dollars (AUD)

  • Include GST where applicable

Shipping costs are displayed at checkout or provided separately where required.

Full payment is required at the time of purchase.

You warrant that you are authorised to use the payment method provided.

We reserve the right to correct pricing errors and cancel orders where necessary.

6. Shipping and Risk

Delivery timeframes are estimates only and are not guaranteed.

We are not liable for delays caused by carriers, customs processing or events outside our reasonable control.

Risk in the goods passes to you upon delivery to the nominated delivery address.

Title (ownership) passes to you once full payment has been received.

7. Returns and Refunds

Returns, exchanges and refunds are governed by our Returns Policy.

Nothing in these Terms limits your rights under the Australian Consumer Law.

8. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

To the extent permitted by law, where goods are not acquired for personal, domestic or household use, our liability is limited to:

  • Replacement of the goods;

  • Repair of the goods; or

  • Payment of the cost of replacing or repairing the goods.

9. Intellectual Property

All content on the Site, including text, images, logos, designs and graphics, is owned by or licensed to Casa Vietri and is protected by Australian and international intellectual property laws.

You may use the Site for personal, non-commercial purposes only.

You must not reproduce, distribute, modify or exploit any content without prior written consent.

10. Mobile Terms of Service

The Casa Vietri mobile message service (the "Service") is operated by Casa Vietri ("Casa Vietri", "we", or "us"). Your use of the Service constitutes your agreement to these terms and conditions ("Mobile Terms"). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Casa Vietri's SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Casa Vietri through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Casa Vietri. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to Casa Vietri or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Casa Vietri mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

10. Third-Party Services and Links

The Site may include links to third-party websites or services.

We are not responsible for the content, policies or practices of third-party sites.

Your use of third-party services is at your own risk.

11. Feedback

If you submit reviews, comments or other feedback, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and publish that content for promotional or business purposes.

You warrant that your feedback:

  • Is accurate

  • Does not infringe any third-party rights

  • Is not unlawful, defamatory or misleading

We may remove content at our discretion.

12. Errors and Inaccuracies

Occasionally there may be typographical errors, inaccuracies or omissions relating to product descriptions, pricing or availability.

We reserve the right to correct errors and cancel affected orders where necessary.

13. Prohibited Conduct

You must not use the Site:

  • To infringe intellectual property rights

  • To transmit malicious code

  • To interfere with Site functionality

  • To scrape, crawl or extract data without permission

We may suspend or terminate access for breaches of these Terms.

To the maximum extent permitted by law, the Site and its content are provided “as is”.

Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or other applicable legislation that cannot be excluded.

15. Limitation of Liability

To the extent permitted by law, Casa Vietri is not liable for indirect, incidental or consequential loss arising from use of the Site or purchase of products.

Our total liability for any claim relating to goods purchased through the Site is limited to the amount paid for those goods.

This limitation does not apply to rights you have under the Australian Consumer Law.

16. Termination

We may suspend or terminate access to the Site at our discretion if you breach these Terms.

Provisions relating to intellectual property, liability, indemnity and governing law survive termination.

17. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

You submit to the exclusive jurisdiction of the courts of New South Wales.

18. Changes to These Terms

We may update these Terms from time to time.

The current version will always be available on this page. Continued use of the Site constitutes acceptance of any updated Terms.
